The Workroom products and services are provided by Everypixel Labs Inc., registered at 251 Little Falls Drive, Wilmington, DE 19808, USA with a primary correspondence address at 2021 Fillmore Street, PMB 15, San Francisco, CA 94115, USA (hereinafter referred to as “Workroom”).

We help you automate the processes of image recognition such as Age recognition,Tagging and Scoring Aesthetic Quality of Your Photos (collectively “Services”). This Terms of Use apply to the Workroom.

These Terms of Use (hereinafter the “Terms”) govern your access to and use of the Workroom’s website and services https://workroom.everypixel.com, https://app.everypixel.com (hereinafter the “Site”).

Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Products, you shall agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to all of these Terms, do not use this Site. By using the Site, you represent that you are over eighteen (18) and have the authority and right to agree to these Terms. If you are accessing this Site on behalf of any entity, you shall further represent and warrant that you are authorized to accept these Terms on this entity’s behalf, and that such entity agrees to indemnify the WorkRoom for violations of these Site Terms.

Workroom reserves the right to alter, amend, or update these Terms of Use at any time, and you agree to be bound by such amendments, alterations or updates.

1. General Provisions

1.1. The WorkRoom platform provides tools for creating multimedia content using AI technologies.
 1.2. By using the platform, you agree to these Terms.
 1.3. Updates to these Terms will be published on the platform’s website and take effect upon publication.

2. Registration and Access

2.1. Registration can be completed via:

  • Email and password.
  • Google account.

2.2. Upon registration, users must complete the onboarding form, answering:

  • “What do you do?”
  • “What do you use it for?”
  • “How did you hear from us?”
  • Optional: Link to a social network profile.

3. Platform Features

3.1. Home Screen

Features include:

  • Character Creation and Customization:
    • Choose a ready-made character from the library.
    • Generate characters using uploaded photos.
    • Customize characters with advanced settings.
  • Video Creation:
    • Use AI to generate animations and videos.
    • Adjust lighting, camera movements, and backgrounds.
  • Voice Cloning and Lip-Syncing:
    • Generate voiceovers from audio samples.
    • Synchronize lip movements with uploaded audio.
  • Project Management:
    • Store, edit, and download completed projects.

4. Use of the Site and Its Content. Revocation

This Site and its content are intended for use by Workroom customers and visitors. By using the Site and Content, you represent and warrant that you will comply with all applicable laws, including those relating to data, privacy, and the transmission of technical data.

Workroom reserves the right to revoke your authorization to view, download, or use the Content and information available on the Site at any time and for any reason, with or without notifying you. Upon receiving such notice, you agree to immediately discontinue the use.

5. General Disclaimer

The Site and the Content are provided “as is.” Workroom disclaims all warranties, expressed or implied, including implied warranties of merchantability or fitness for a particular purpose.

Workroom will not be liable for any damages arising from:

  • Use or unavailability of the Site or Content.
  • Loss of data, profits, or other damages caused by errors, interruptions, or technical failures.

Some countries do not allow the exclusion of warranties or limitations on damages, so these limitations may not apply to you.

6. Limitation of Liability

Workroom, its directors, employees, or agents shall not be liable for any damages, including but not limited to:

  • Issues arising from reliance on information, errors, or unauthorized access to records or services.

Workroom’s total liability will not exceed the amount paid by the user for access to the platform.

7. Indemnity

You agree to defend, hold harmless, and indemnify Workroom from any claims, costs, or damages arising from:

  • Your use of the platform.
  • Breach of any part of these Terms.
  • Any disputes over payments or account activity.

8. Ownership of Generated Content and Copyright Protection

    Content Ownership

    All rights to content created using our platform belong entirely to the user who generated it. This means you retain full rights to use, distribute, sell, or license the generated content without any restrictions from the platform.

    Copyright Protection

    We respect intellectual property rights and expect the same from our users. You are solely responsible for ensuring that your content complies with copyright laws and does not infringe on the rights of third parties.

    No Platform Claims

    We do not claim any copyright ownership over the content you create and will not use it without your permission. All rights to commercial use and monetization belong exclusively to you.

    9. Termination and Account Suspension

    Violation of Agreement Terms

    We reserve the right to suspend or terminate your account if you violate the terms of this agreement.

    Violation of Acceptable Use Policy

    Your account may be suspended if you engage in any activity prohibited by our acceptable use policy, including but not limited to:

    Infringement of intellectual property rights.

    Breach of confidentiality.

    Distribution of harmful content or spam.

    Risk of Harm

    We may suspend or terminate access to your account if we determine that your actions could cause harm to the platform, other users, or third parties.

    Termination by You

    You may cancel your subscription at any time, provided you notify us at least 15 days in advance of the intended cancellation date. If you cancel for reasons beyond our control, paid credits are non-refundable. If the cancellation is due to technical issues with the platform, we will refund all unused credits.

    We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that could cause harm to us or other users.

    10. Data Storage and Account Deletion

    Data Storage Duration

    Your uploaded photos and videos are stored indefinitely unless otherwise specified in the terms of use. We provide the option to replace or update your uploaded content upon request.

    Data Deletion by Request

    You have the right to delete your uploaded data at any time. To do so, you must submit a request through your account settings or contact our support team.

    Inactive Account Deletion

    We reserve the right to delete accounts that remain inactive for 12 consecutive months. Prior to deletion, we will send you a notification 30 days in advance, allowing you the opportunity to save your data or restore access to your account.

    11. Usage Restrictions and Commercial Use

    Commercial Use

    You are permitted to use our service for commercial purposes, including business, marketing, and advertising. However, by using the platform for commercial purposes, you agree that:

    • All responsibility for the content you create lies with you as the author.
    • We, as a service, do not verify content and make no guarantees that its use does not infringe on the rights of third parties.

    Content Restrictions

    When creating content using our platform, you agree not to violate copyrights, image rights, or other intellectual property rights of third parties. This includes prohibiting the creation of content featuring real individuals without their consent, such as deepfakes of celebrities or any known individuals without official permission.

    Disclaimer of Liability

    We are not responsible for any claims related to copyright infringement, intellectual property violations, or image rights arising from the use of content created by you. All obligations to comply with applicable laws and third-party rights rest solely with the user.

    12. Governing Law and Jurisdiction

    These Terms shall be governed by the laws of the jurisdiction where Workroom is headquartered.

    13. Notification Procedures and Changes

    Workroom reserves the right to determine how notifications are provided and may use electronic means. Updates to these Terms will be accessible on the website, and continued use implies acceptance.
